Pilot Dispute Resolution Process (DRP)

In April 2007, the Intermodal Interchange Executive Committee (IIEC) approved a pilot Dispute Resolution Process for testing and evaluation for possible inclusion in the UIIA. The purpose of the program is to provide an alternative method for resolving issues involving per diem and/or maintenance and repair invoices after all dispute resolution processes under the UIIA/EP Addenda have been exhausted.

Participation in the pilot DRP is currently limited during the testing phase to UIIA Motor Carriers and Equipment Providers that have business operations in the following states:

  • California — pilot implemented on July 1, 2007 – Claims must have occurred after May 2, 2007 to be considered under the pilot DRP.
  • Northeastern US region — pilot implemented on December 1, 2007 – Claims must have occurred after September 1, 2007 to be considered under the pilot DRP.

Modifications to UIIA Agreement

A notice was sent to all UIIA participants on May 7, 2007 advising that the Intermodal Interchange Executive Committee (IIEC) had adopted specific modifications/revisions to the Uniform Intermodal Interchange and Facilities Access Agreement (UIIA). These proposed revisions were forwarded to all participants and a thirty-day comment was provided. All comments received were forwarded to the IIEC for review and further consideration. The Committee has decided to move forward with all of the proposed modifications to the UIIA. The effective date of the revisions will be July 25, 2007.

IANA Advises FMCSA To Re-Examine Proposed Roadability Rule

IANA on March 21 filed comments with the Federal Motor Carrier Safety Administration regarding the agency's roadabilty proposal that affects intermodal equipment providers, motor carriers and drivers operating intermodal equipment. IANA is asking FMCSA to re-examine important sections of the proposal relating to the Uniform Intermodal Interchange & Facilities Access Agreement.




AAR TOFC/COFC Interchange Rules Revised Effective Jan. 1, 2007

The Association of American Railroads (AAR) has revised the AAR Intermodal Interchange Rules effective January 1, 2007. Sections B, F and G of the AAR Intermodal Interchange Rules are referenced in Section D.3.d (1) of the Uniform Intermodal Interchange and Facilities Access Agreement (UIIA) as the controlling document for the classification of Wear and Tear.
